PRESS RELEASE:
The U.S. Department of Labor’s Occupational Safety and
Health Administration has cited the Allen Family Foods Inc. poultry processing facility in Harbeson for exposing workers to a variety of workplace safety hazards. Proposed penalties total $182,200.
OSHA initiated an investigation on Sept. 9, 2009, in response to a referral made by Maryland Occupational Safety and Health after numerous serious and willful violations were issued at a similar processing facility in Maryland.
OSHA has cited the company with 45 serious violations and proposed a penalty of $182,000, and two other-than-serious violations with a proposed penalty of $200. The serious violations address hazards with industrial trucks, falls, personal protective equipment, machine guarding, electrical hazards, process safety management, respirators and
emergency response. OSHA issues a serious citation when there is substantial probability that death or serious physical harm could result and the employer knew, or should have known, of the hazard.
“It is vital that the company abate these hazards as quickly as possible to ensure that safety and health of workers at that facility are not at risk,” said Domenick Salvatore, director of OSHA’s Wilmington, Del., office.
The company has 15 business days from receipt of the citations to comply, request an informal conference with OSHA’s area director, or contest the citations and proposed penalties before the independent Occupational Safety and Health Review Commission. The investigation was conducted by OSHA’s Wilmington Area Office; telephone: 302-573-6518. To report workplace accidents, fatalities or situations posing imminent danger to workers, call OSHA’s toll-free hotline at 800-321-6742.
Under the Occupational Safety and Health Act of 1970, employers are responsible for providing safe and healthful workplaces for their employees. OSHA’s role is to assure these conditions for America’s working men and women by setting and enforcing standards, and providing training, outreach, education and assistance. OK, now that we have OSHA’s version of the story, or at least that is how the alleged news release reads, (wonder who tipped off OSHA, Perdue or Mountaire?) what is the company, or its legal team, saying about these citations? When was Allen officially served the papers, to start the 15-day clock on a response? True, false, unfair, we’ve fixed ‘em all, go away, tell “Frank” thanks alot, no comment?? The allegations can’t be too serious. They started this “investigation” in September; it’s now March, six months later, and they have allowed this company to operate with potentially deadly consequences for these employees and anyone else who may come into their facilities? I thought driving behind an Allen truck loaded with chickens stinks, but THIS smells even worse!
