Lawsuit Challenging RGGI Dismissed by Sussex Superior Court Judge

A lawsuit that challenged Delaware’s participation in a program aimed at reducing carbon dioxide emissions and funding renewable energy programs is getting dismissed.  The lawsuit was brought in December 2013 by three people who claimed that the state’s participation in the Regional Greenhouse Gas Initiative caused an increase in their electric bills.  After more than four years of litigation, a judge dismissed the suit last week saying, “Instead of seeking to correct an actual harm, plaintiffs are officiously meddling with Delaware’s RGGI Act.” They also failed to demonstrate the program’s effect on their bills.
