Delaware Bill Seeking to Expand Access to Mental Health Care Passes Senate

A bill aimed at expanding access to mental health and substance use disorder treatment in Delaware has passed the Delaware Senate. Known as the “Fair Standards in Mental Health Care Act”, the legislation would require insurers to cover all medically necessary mental health and addiction treatment, eliminate certain prior authorization delays, and ensure emergency mental health services are covered. The bill would also require insurers to use evidence-based clinical standards, improve access to addiction treatment medications, prohibit discrimination based on mental health conditions, and provide out-of-network coverage at no extra cost when in-network providers are unavailable. The measure would apply to health insurance policies issued or renewed after December 31st, 2027. This legislation-Senate Bill 22– is now ready for action from the Governor.Ā
