UPDATED: Sussex County Council Vote on Conditional Use Application Remanded back to Council after Appeal to Superior Court
UPDATED – 10/13/26 – The Sussex County Council met Tuesday afternoon – the meeting beginning at 12:30pm. In Old Business, the Council revisited Conditional Use No. 2533 on behalf of RWE Clean Energy, proposed for an area near Route 54/Cypress Road and Cliff Road south of Frankford. County Attorney Everett Moore told the Council that their original denial of this application was appealed to Superior Court. The Court on September 16th remanded the issue back to the County Council for a new vote. When the Council voted Tuesday on the motion to approve the Conditional Use application, the vote was 3 to 1 to approve the application with Council President, Doug Hudson, standing by his original vote of “no.” Councilman John Rieley was absent.
The Council approved a proclamation request for United States Navy Week, which County Administrator, Todd Lawson, discussed briefly. The US Navy will visit Delaware October 19th through 25th and will spend some time in Sussex County. In a release from the US Navy Office of Community Outreach, this is part of Navy Weeks, which have been ongoing since 2005 – but this year sailors are on a celebratory “Road Trip to 250” as the country celebrates its 250th anniversary. During Sussex County Navy Week, sailors will connect with the community and share their experiences serving in the modern fleet, who are taken care of and always mission-ready. They are expected to visit various locations including the Delaware Coastal Airport which will include a musical performance and the Sea Witch Festival in Rehoboth Beach.
There were three public hearings to end the meeting. One was an update and three motions from Brandy Nauman, Director of Community Development and Housing for Sussex County. She updated the Council on where the funding through the Community Development Block Grant program was spent – as well as funding from the County. The Council approved three resolutions that she brought – on Fair Housing, Citizen Participation and approval from the County on the Target Area requests described in the grant applications and approval to apply for Community Development funds from the Delaware State Housing Authority.
Two Conditional use applications were also approved by the Council with unanimous votes. The Council approved Conditional Use No. 2529 on behalf of Jaime & Darren Hooks for a mechanic repair business, office, material and equipment storage on just over 4 acres on Airport Road in Laurel. The Council also approved Conditional Use No. 2573 on behalf of Total Package Landscaping, Inc. for a landscaping business with employee parking and equipment storage on Beaver Dam Road near Kendale Road west of Lewes.
The Council will meet next Tuesday with a meeting currently scheduled to begin at 1pm – and four public hearings on Conditional Use applications for solar arrays.
