Federal Gov’t Seeks Deadline Extension to Reconsider US Wind Construction & Operations Plan and Seek Remand in Ocean City’s Federal Lawsuit


The Federal Government now plans to reconsider approvals to the US Wind Construction and Operations Plan (COP) and seek a voluntary remand in Ocean City’s Maryland Federal District Court lawsuit which seeks to overturn the US Department of Interior’s COP approval. The Federal Government filing on July 28 in Delaware Federal District Court comes in a lawsuit filed earlier this year by South Bethany property owner Ed Bintz. The Federal Government is seeking additional time to respond to Bintz’ lawsuit to reconsider the COP approval and move in the District of Maryland for voluntary remand of that agency action – which has the potential to affect Bintz’s claims in the case. The Federal Defendants – Department of the Interior and US Army Corps of Engineers – request an extension of their deadline to respond to Bintz’s complaint until September 5, 2025.
