Honorable Timothy Fox Named New Magistrate in Chancery

The Honorable Timothy Fox, Jr. has joined the Court of Chancery as Magistrate in Chancery. Magistrate Fox’s chambers will be located in Wilmington, but will handle matters throughout the State of Delaware. He replaces Senior Magistrate Selena Molina who retired from the bench earlier this year. Before joining the bench, Magistrate Fox served for 12 years as a trial attorney with the Office of the U.S. Trustee at the U.S. Department of Justice in Wilmington, Delaware, with responsibilities in all matters arising under the United States Bankruptcy Code, primarily Chapter 11 cases.

Magistrate Fox is a Delaware resident and a graduate of C.D. Hilton Senior High School in Woodbridge, Virginia. He earned his undergraduate degree from Virginia Commonwealth University, summa cum laude, and his law degree from George Mason University School of Law, magna cum laude. During his legal training, Magistrate Fox completed a summer clerkship with the Prince William County Attorney’s Office in Woodbridge, Virginia; a summer internship at Bloomberg BNA’s Corporate Practice Series in Arlington, Virginia; and a legal externship with the Executive Office of the U.S. Trustee at the U.S. Department of Justice in Washington, D.C.
Magistrate Fox has been an active member of the Delaware Bankruptcy Inn of Court since 2014, where he served as Program Chair from 2023 to 2025. He also has served as an Articles Editor on the George Mason Law Review and as an INSOL International Fellow.

McCormick. “In particular, his experience in insolvency proceedings brings a helpful skillset to the court and will enhance the court’s ability to handle receivership, custodian, and dissolution proceedings, as well as petitions for the assignment for the benefit of creditors.”
