Delaware lawmakers Monday discussed the possibility of taking action in the case of indicted State Auditor Kathy McGuiness.

During the special session on redistricting, the Senate passed a resolution (SCR 63) to seek an advisory opinion from the Delaware Supreme Court on what circumstances, including indictment, warrant legislative action to remove a public official. It passed 14-7 along party lines, with Democrats in favor and all seven Republicans opposed.

The House voted 25-8 in favor of a resolution (HCR 42), but with different wording, to get an advisory opinion from the Delaware Supreme Court. Six representatives answered ‘not voting’ and two were absent.

McGuiness was indicted on several charges related to her office October 11th. She pled not guilty and claims she is innocent of all charges.
