DE General Assembly Approves Bill to Delay Implementation of SB 159
Senate Bill 159 was amended and passed in the State House and then again approved in the State Senate and signed into law by Governor Meyer Monday evening. However the Delaware Senate Republican Caucus later announced the crafting and passage of Senate Bill 199, which will delay the implementation of SB 159 until January 31st of 2026. This will allow the ongoing appeal filed by US Wind against the Sussex County Council for its denial of a conditional use permit for an electric substation near Dagsboro to proceed without legislative interference. The agreement protects the authority of the Delaware courts to decide the matter fairly and independently.
SB 199 was passed in the Senate with a unanimous vote and in the State House with a vote of 39 to 0 with 1 absent and 1 vacancy.
