Delaware Bill to Establish Adult-use Cannabis Industry Becomes Law at Midnight

As of midnight tonight, a law will go into effect in Delaware and 21 other states as well as three U.S. territories, that legalizes an adult-use cannabis market.

House Bill 2, which will go into effect without Governor Carney’s signature, establishes the legal framework for a cannabis industry with a focus on local, small business and legacy participation. The comprehensive legislation also creates a justice reinvestment fund from 7% of the tax revenue collected on legal sales, earmarked for communities which data shows have been disproportionately impacted by the enforcement of cannabis prohibition, and establishes both standardized consumer safety measures and robust underage-use prevention provisions.
